Sub. : Public Suggestions on The Waqf (Amendment) Bill 2024
Respected Sir!
The government of India deserves appreciation that it recognized that Waqf Boards need change. I truly support the amendments brought by the government, however I have some suggestions for the Joint Parliamentary Committee (JPC) that could make some significance difference.
1. Diversify the advisory board : The government should consider bringing at least 40% participation of non-Muslims on the advisory boards of Waqf.
2. Report to government ministries: Waqf advisory boards should report directly to a designated Ministry.
3. Judicial oversight: Waqf tribunals should be not autonomous bodies but should come under the supervision of High Courts and the Supreme Court.
4. Equitable tax and subsidy treatment: The subsidies, taxes, debts, and rebates applicable to Waqf should be on par with those available to other religious and charitable organizations.
5. Digitize and disclose: Digitization of the waqf properties should be done and shown on a dedicated registration portal.
6. Time-limited legal disputes: Any legal matter must be resolved within a specified time not more than three months.
7. Rigorous annual audits: All Waqf Boards must undergo annual audits by the CAG or a separate designated authority.
8. Scrutinized foreign funding: No foreign agency should be allowed to donate to the Waqf board without the government’s permission.
9. No more free-for-all land grabs: The ability to claim public, cultural, private, and government properties as Waqf properties has to be snapped with immediate effect.
10. Proposed DM’s survey Must be made challenge able: DM’s survey must not be the final decision it must be challenge able in the High Court and Supreme Court for determining true ownership. The legal provisions should be formed in a way that scrutiny of Waqf Boards’ decisions becomes a must.
