Police Report Below
I responded to the location regarding a motor vehicle crash. Upon arrival, I made contact with Ramiro Torres and Walter Maldonado, who were in the vehicle traveling northbound on Valdes Ave. Torres, the driver, struck two vehicles and a decorative light post. Torres admitted to driving, and Maldonado was the passenger.
While investigating the crash, Maldonado repeatedly walked into the roadway. I instructed him multiple times to stand on the sidewalk while I spoke with Torres. Maldonado, visibly intoxicated, continued entering the street behind me during the investigation. I informed him again that if he didn’t stay on the sidewalk, he would be arrested. Maldonado refused to comply.
I grabbed his left arm to place him under arrest, but he attempted to pull away. I placed Maldonado in a left arm bar and forced him to the ground, ordering him to turn onto his stomach and place his hands behind his back. He complied, and I handcuffed him without further incident. He was escorted to the back of the police cruiser so I could continue my investigation. Maldonado refused to provide a valid name or date of birth, even with the assistance of a Spanish language interpreter. He was transported to SCJ for Disorderly Conduct (Intoxication) and Obstructing Official Business.
I returned to Torres, who was unsteady on his feet, with glossy, bloodshot eyes. When asked, he stated he had consumed one beer before driving. I requested that Torres perform field sobriety tests, and he agreed. During the Horizontal Gaze Nystagmus (HGN) test, Torres exhibited lack of smooth pursuit, sustained nystagmus at maximum deviation, and onset of nystagmus before 45 degrees in both eyes.
During the walk-and-turn test, Torres was unable to maintain his balance, took multiple steps off the line, and used his arms for balance. After completing nine steps, he continued walking forward without turning around until instructed to stop. He did not attempt the one-leg stand, instead trying to restart the walk-and-turn test.
Torres was placed under arrest and transported to the 5th floor of the station for testing. He was read and shown the BMV2255 form at 22:52 but refused to submit a urine sample at 22:53. Torres also admitted that he did not possess a valid driver’s license in either the U.S. or Honduras. He was cited for Failure to Control, OVI, and No Valid Driver’s License.
Torres was later released to Shelby Parrot, who provided Maldonado’s identifying information.
