So, you got pulled over and you’re sitting on the road. The officer is pestering you about random things or is asking you questions about where you’re going, if they can search you, etc. What do you do?
If you have already dealt with the reason for the stop (likely a traffic violation), ask, “Am I free to go?” This puts the officer in a position where they need to come up with a legal reason to keep you there. If they say no, ask them what else needs to be done before you can go on your way. Again, they need a legal answer before the situation turns into illegal detainment.
They’re still keeping you without reason? Ask them this, “Is your body cam turned on? I would like documentation of this stop. I will be getting my phone out to record as well.” Hopefully this gives them a hint that you know your rights and they need to let you go.
