Derek Poe, the man who carried his unloaded rifle through Parkdale Mall, was in court Friday.
Poe was charged with disorderly conduct on December 28th after police received a safety complaint from someone in the mall.
At the pre-trial hearing Friday, a Jefferson County judge refused a defense request to throw out the case.
The defense is questioning the law and authenticity of the complaint.
Poe is due back in court on October 20th
